Livity Way (“we”, “us”, “our”) respects your privacy and is committed to protecting your personal and health information. This policy explains what information we collect, how we use it, and your rights regarding that information.

What information we collect

We only collect information that’s necessary to provide safe, effective personal training services. Depending on how you interact with us, this may include:

Contact information Name, date of birth, email address, mobile number, and emergency contact details.

Health information Through our Waiver and Physical Activity Readiness Questionnaire (PAR-Q), we collect information about your medical history, current medications, injuries, pregnancy status, and any other health factors relevant to safe exercise. Health information is classified as “sensitive information” under the Australian Privacy Act and is given the highest level of protection.

Training information Notes on your goals, progress, training preferences, and session history.

Photos and videos (only with your consent) If you opt in via the consent question on the PAR-Q form, we may take photos or videos for tracking your progress or marketing purposes. You can withdraw this consent at any time.

Payment information If you pay for services, basic billing details. We do not store credit card numbers — these are handled directly by our payment provider.

Website information Standard technical data such as IP address, browser type, and pages visited. This helps us maintain the website and is collected automatically.

How we collect your information

We collect information directly from you when you:

  • Complete the PAR-Q / Waiver form on our website
  • Contact us through our website contact form, email, phone, or in person
  • Sign up for or attend training sessions
  • Provide feedback or testimonials

We don’t buy information from third parties or collect information about you from anyone else (except your emergency contact’s name and number, which you provide).

Why we collect your information

We use your information to:

  • Assess your suitability for exercise and identify any health risks before training
  • Design appropriate training programs for your goals and abilities
  • Contact you about sessions, scheduling, and changes
  • Reach your emergency contact if needed during a session
  • Process payments for services
  • Improve our services
  • Meet our legal, tax, and insurance obligations

We will not use your information for any purpose you haven’t been informed of, and we won’t use your health information for marketing.

Who we share your information with

We don’t sell your information, ever. We share information only in these limited circumstances:

  • Your emergency contact — only if there’s a medical emergency during training
  • Healthcare providers — only with your consent, for example if we need to coordinate with your physiotherapist or doctor
  • Payment processors — if you pay online, your billing details are handled directly by our payment provider
  • Our hosting provider (VentraIP) — your form submissions are stored on Australian-based hosting servers
  • Legal authorities — if required by Australian law

How we store and protect your information

Your information is stored:

  • In our website database, hosted by VentraIP on Australian-based servers
  • In our training records (paper or digital notes used to plan and track your sessions)
  • In our email and accounting systems

We protect your information by:

  • Using a secure (HTTPS) website with up-to-date security software
  • Restricting access to your information to authorised people only (currently just [your name])
  • Using strong passwords and two-factor authentication on all systems
  • Storing physical records (if any) securely

No system is 100% secure, but we take reasonable steps to protect your information from misuse, interference, loss, unauthorised access, modification, or disclosure.

How long we keep your information

We keep client records for seven (7) years after our last interaction with you. This is in line with Australian record-keeping requirements for tax, insurance, and professional liability purposes.

After this period, we securely delete or de-identify your information.

If you ask us to delete your information sooner, we will do so where we’re legally permitted — but some information must be retained for the full seven years to meet our legal obligations.

Your rights

Under the Australian Privacy Principles, you have the right to:

  • Access your information — ask for a copy of what we hold about you
  • Correct your information — ask us to update anything that’s inaccurate
  • Withdraw consent — for example, withdrawing photo/video consent at any time
  • Request deletion — subject to legal retention requirements
  • Make a complaint — if you believe we’ve mishandled your information

To exercise any of these rights, email us at [your email]. We’ll respond within 30 days.

If you’re not satisfied with our response, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or 1300 363 992.

Cookies and website tracking

Our website uses minimal cookies, which are small files stored on your device:

  • Essential cookies — required for the website to function (e.g. caching for faster loading via LiteSpeed Cache)
  • Form data — temporary cookies used by Fluent Forms to remember your input if you navigate away mid-form

We don’t currently use third-party analytics or advertising trackers. If we add these in future, we’ll update this policy and seek consent where required.

Changes to this policy

We may update this policy from time to time. The “last updated” date at the top will reflect the most recent change. For significant changes, we’ll notify existing clients by email.
